WHEREAS the Settlor is desirous of creating a Public Charitable and Religious Trust for the purposes hereinafter mentioned;

NOW THIS DEED WITNESSETH AS FOLLOWS:

1.   NAME OF THE TRUST

The Trust shall be called “[Name of the Trust]”.

2.  REGISTERED OFFICE

The registered office of the Trust shall be situated at [Complete Address].

3.  OBJECTIVES

The objectives of the Trust shall be:

  1. To establish, maintain and run charitable institutions
  2. To provide medical relief and establish hospitals
  3. To promote education including schools and scholarships
  4. To relieve poverty and distress
  5. To maintain religious places and conduct religious activities
  6. Any other charitable purposes as recognized under Section 2(15) of Income Tax Act, 1961

4.  INITIAL CORPUS

The Settlor hereby donates a sum of ₹[Amount] (Rupees [Amount in words]) as initial corpus of the Trust.

5.  TRUSTEES

  1. The initial Trustees shall be the persons named above
  2. The number of Trustees shall not be less than 2 and not more than 7
  3. New Trustees may be appointed by majority resolution
  4. A Trustee may resign by giving one month notice

6.  MANAGEMENT

  1. The Trustees shall manage the Trust property
  2. Decisions shall be taken by majority vote
  3. The Trustees may frame Rules and Regulations for administration

7.  MEETINGS

  1. Annual General Meeting shall be held every year
  2. Minimum two meetings shall be held in a year
  3. Quorum shall be 2/3rd of total Trustees

8.  BANK ACCOUNT

The Trust shall open a bank account in a scheduled bank and all transactions shall be through this account.

9.  ACCOUNTS

  1. Proper books of accounts shall be maintained
  2. Accounts shall be audited annually if income exceeds ₹5 lakhs
  3. Financial Year shall be from 1st April to 31st March

10.  APPLICATION OF INCOME

The income of the Trust shall be applied solely towards the objects of the Trust and no portion shall be paid to Trustees except as reasonable remuneration for services rendered.

11.  AMENDMENT

This Deed may be amended by resolution passed by 3/4th majority of Trustees, provided such amendments are consistent with the charitable nature of the Trust.

12.  DISSOLUTION

In case of dissolution, the remaining assets shall be transferred to another Trust with similar objectives.

13.  REGISTRATION

The Trustees shall apply for registration under:

  1. Indian Trusts Act, 1882
  2. Section 12A/12AA of Income Tax Act, 1961
  3. Section 80G of Income Tax Act, 1961
